(1) These regulations may be cited as the Traffic Regulations 1976.
(2) These regulations shall come into force on 1 February 1977.
In these regulations, unless the context otherwise requires,—
Act means the Land Transport Act 1998
adjustable spot lamp means a lamp to provide a narrow beam of light that may be aimed at will by the driver
Agency means the New Zealand Transport Agency established under section 93 of the Land Transport Management Act 2003
all terrain vehicle means a special purpose vehicle (with or without motorcycle controls and equipment) that—
(a) is principally designed for off-road use; and
(b) has 3 or more wheels; and
(c) has an engine capacity exceeding 50 ml; and
(d) has a gross weight of less than 1 000 kg
approved—
(a) in relation to child restraints, means approved by the Agency under section 77B of the Act:
(b) in relation to any other appliance, apparatus, device, system, component, equipment, or fitting, means approved by the Agency under these regulations
articulated vehicle means any motor vehicle with a trailer attached, so that part of the trailer is superimposed upon the motor vehicle and a substantial part of the weight of the trailer and of its load is borne by the motor vehicle. Such a trailer shall be called a semi-trailer
auxiliary headlamp means a forward-facing lamp used under certain conditions to replace the headlamps; and includes a fog-lamp, being a vehicle-lamp providing illumination in conditions of fog, snow, cloud, or other atmospheric conditions which reduce visibility
breakdown vehicle means any motor vehicle designed or adapted for the lifting and towing of motor vehicles that have met with mishap; but does not include a motorcar
carriage includes haulage
centre line,—
(a) in relation to any portion of a roadway not marked with a flush median, means a dotted or solid line or lines of paint or raised studs (or any combination of those lines and studs) intended to separate opposing traffic:
(b) in relation to any portion of a roadway marked with a flush median, means the longitudinal white line that forms the left side of the flush median as viewed by a driver facing forward
certificate of fitness or permit, except in the definition in this regulation of the term evidence of vehicle inspection, means evidence of vehicle inspection
controlled intersection means any intersection where the traffic is for the time being controlled by a traffic officer or Police officer or by traffic control lights
controlling authority, in relation to any road, means the authority, body, or person or persons having control of the road and includes any person acting under and within the terms of any delegation or authorisation given by a controlling authority
cycle means a vehicle having at least 2 wheels and designed to be propelled solely by the muscular energy of the rider
direction-indicator lamp means a lamp used for signalling an intention to change direction to the right or to the left
driver means the driver of a vehicle; and includes the rider of a motorcycle or moped or cycle; and drive has a corresponding meaning
erect includes place in position
erecting authority, in relation to any road, means the controlling authority; and includes any duly incorporated association or union of motorists (hereinafter referred to as an automobile association)
evidence of vehicle inspection, in relation to a motor vehicle, means anything that is a certificate, label, or document issued under the Land Transport Act 1998, or under land transport rules, as evidence of the completion of the periodic vehicle inspection requirements in respect of that vehicle; and includes—
(a) a certificate of fitness or permit issued under section 79 of the Act and these regulations before 1 March 1999; and
(b) a warrant of fitness issued under these regulations before 1 March 1999
fire authority means a Chief Fire Officer or Deputy Chief Fire Officer appointed under the Fire Service Act 1975 or a Rural Fire Officer appointed under the Forest and Rural Fires Act 1977, as the case may require
flush median, in relation to any portion of a roadway, means an area marked by white diagonal lines which—
(a) are painted along the middle of the roadway; and
(b) are bounded by approximately parallel, longitudinal white lines—
for the purpose of separating opposing traffic
footpath means a path or way principally designed for, and used by, pedestrians; and includes any footbridge
forward length—
(a) in relation to a motor vehicle other than a trailing unit, means the distance from the rear axis to the foremost part of the vehicle or its load, whichever is the greater:
(b) in relation to a trailing unit the front axle of which is steered by the towbar, means the greater of the following distances:
(i) from the front axle of the trailing unit to the point of attachment of the tow-bar to the towing vehicle:
(ii) from the rear axis of the trailing unit to the front axle:
(c) in relation to any other trailing unit, the distance from the rear axis of the trailing unit to the point of attachment to the towing vehicle
goods means all kinds of movable personal property, including animals and mails
goods-service vehicle or goods vehicle means a motor vehicle designed exclusively or principally for the carriage of goods
gross vehicle mass, in relation to any vehicle, means the greatest of the following masses:
(a) the mass specified as the gross vehicle mass by the manufacturer of the vehicle:
(b) the mass specified as the gross vehicle mass of the vehicle, or of a vehicle of that kind, by the Agency by notice in writing to the owner:
(c) the mass of the vehicle, together with the load that the vehicle is for the time being carrying, including any equipment and accessories
headlamp means a forward-facing vehicle lamp displaying a beam of light substantially white or amber in colour to provide illumination of the road ahead, incorporating one or both of—
(a) main (driving or upper) beam—a beam of light from a headlamp providing distant illumination of the road ahead when no other vehicle is approaching and no other vehicle is being followed:
(b) dipped (passing or lower) beam—a beam of light from a headlamp to illuminate the road ahead of the vehicle when meeting or following other vehicles
heavy motor vehicle means a motor vehicle (other than a motorcar that is not used, kept, or available for the carriage of passengers for hire or reward) the gross laden weight of which exceeds 3 500 kg
hours of darkness means—
(a) any period of time between half an hour after sunset on one day and half an hour before sunrise on the next day; or
(b) any other time when there is not sufficient daylight to render clearly visible a person or vehicle at a distance of 100 m
independent brake means a brake of which the entire operating mechanism or system is either—
(a) distinct and separate from all parts or connections of any other brake or brake system, so that the independent brake cannot be adversely affected by the operation or failure of any other brake; or
(b) common to any other brake or brake system only in parts or connections which are of such design and strength that under normal operating conditions and with a proper standard of maintenance there is no reasonable probability of failure by reason of the failure of any other brake or brake system
intersection, in relation to 2 or more intersecting or meeting roadways, means that area contained within the prolongation or connection of the lateral boundary lines of each roadway:
provided that for the purposes of this definition 2 roadways separated only by a traffic island or by a median less than 10 m wide shall be deemed to be 1 roadway:
provided also that at a roundabout or rotary junction the approaches to which are marked by signs in the form of sign P 28 in Schedule 4, a vehicle having entered the central circulating roadway from an approach roadway shall be deemed to enter separate intersections as it approaches each area where its intended path of travel may conflict with the path of travel of vehicles entering from other approach roadways
land transport rules means any of the following rules:
(a) the ordinary rules and emergency rules made under the Land Transport Act 1998; and
(b) the rules referred to in section 220 of that Act
lane, in relation to any roadway, means a longitudinal strip of the roadway at least 2.5 m wide, intended for the passage of traffic, which is separated from other parts of the roadway by a longitudinal line or lines of paint or raised studs; but does not include any flush median or any area on either side of the roadway on which diagonal lines have been marked. A 2-way road divided by a centre line is deemed to be marked in lanes
left side, in relation to a vehicle, means its side to the left of the vehicle when the vehicle is facing forward
level crossing has the same meaning as in section 4(1) of the Railways Act 2005
light rail vehicle has the same meaning as in section 4(1) of the Railways Act 2005
light rail vehicle lane means a length of lane containing a light rail vehicle track on a roadway that is defined—
(a) in the case of a light rail vehicle lane that is a continuous loop, by light rail vehicle lane signs erected at any point where the light rail vehicle lane crosses any intersection:
(b) in any other case, by—
(i) a light rail vehicle lane sign erected at its beginning; and
(ii) a light rail vehicle lane sign erected at its end; and
(iii) light rail vehicle lane signs erected at any point where the light rail vehicle lane crosses any intersection
limit line means a line marked on the surface of the roadway to indicate the place where traffic is required to stop for the purpose of complying with a stop sign, give-way sign, or traffic signal
limited speed zone means a limited speed zone declared under regulation 21(2)
local authority means a City Council, a Borough Council, a County Council, a District Council, or a Town Council
local speed limit means a speed limit for motor-vehicle traffic duly imposed by a controlling authority
medical practitioner means a health practitioner who is, or is deemed to be, registered with the Medical Council of New Zealand continued by section 114(1)(a) of the Health Practitioners Competence Assurance Act 2003 as a practitioner of the profession of medicine
mobility device means—
(a) a vehicle that—
(i) is designed and constructed (not merely adapted) for use by persons who require mobility assistance due to a physical or neurological impairment; and
(ii) is powered solely by a motor that has a maximum power output not exceeding 1 500 W; or
(b) a vehicle that the Agency has declared under section 168A(1) of the Land Transport Act 1998 to be a mobility device
moped means a motor vehicle running on 2 or 3 wheels that is fitted with a motor having a power output not exceeding 2 kW and is designed to be ridden at a speed not exceeding 50 km per hour under normal conditions of use
motor vehicle means a vehicle drawn or propelled by mechanical power; and includes a trailer; but does not include—
(a) a vehicle running on rails; or
(b) [Revoked]
(c) a trailer (not being a trailer designed solely for the carriage of goods) that is designed and used exclusively as part of the armament of any of Her Majesty's Forces; or
(d) a trailer running on 1 wheel and designed exclusively as a speed-measuring device or for testing the wear of vehicle tyres; or
(e) a vehicle designed for amusement purposes and used exclusively within a place of recreation, amusement, or entertainment to which the public does not have access with motor vehicles; or
(f) a pedestrian-controlled machine; or
(g) a vehicle that the Agency has declared is not a motor vehicle under section 168A of the Land Transport Act 1998; or
(h) a mobility device
motorcar means a motor vehicle (other than a motorcycle or power cycle) designed exclusively or principally for the carriage of persons not exceeding 9 in number inclusive of the driver; and includes a motor vehicle which is designed principally for the carriage of passengers but which has rear doors and collapsible rear seats
motorcycle means a motor vehicle running on 2 wheels, or not more than 3 wheels when fitted with a sidecar; and includes an all terrain vehicle (irrespective of the number of wheels on the vehicle); and includes any vehicle with motorcycle controls declared by the Agency to be a motorcycle, but does not include a moped
mudguard means that fitting (inclusive of any portion of the vehicle and of any flaps attached) which serves to intercept material thrown up by a wheel more or less in the plane of the wheel and which is of an effective width not less than the total width of the tyre or tyres on that wheel
non-steering axle means any axle of a vehicle the wheels of which remain substantially parallel with the longitudinal centre-line of the vehicle while the vehicle is turning
omnibus means a passenger vehicle that has more than 9 seating positions (including the driver's seating position)
to operate means to use or drive or ride on any road, or cause or permit to be driven or ridden on any road, or to permit to be on any road, whether the person operating is present in person or not
owner, in relation to a motor vehicle, means the person lawfully entitled to possession thereof, except where—
(a) the motor vehicle is subject to a bailment that is for a period not exceeding 28 days; or
(b) the motor vehicle is let on hire pursuant to the terms of a rental-service licence,—
in which cases owner means the person who, but for the bailment or letting on hire, would be lawfully entitled to possession of the motor vehicle; and owned and ownership have corresponding meanings
parking means—
(a) in relation to any portion of a road where parking is for the time being governed by the location of parking meters placed pursuant to a bylaw of a local authority, the stopping or standing of a vehicle on that portion of the road for any period exceeding 5 minutes:
(b) in relation to any other portion of a road, the stopping or standing of a vehicle (other than a vehicle picking up or setting down passengers in a restricted parking area, and entitled to do so) on that portion of the road;—
and park has a corresponding meaning
parking brake means a brake readily applicable and capable of remaining applied for an indefinite period without further attention than the initial application
pedestrian means any person on foot upon a road; and includes any person in or on any contrivance equipped with wheels or revolving runners which is not a vehicle
Police officer includes any member, of whatever level of position, of the Police
rail vehicle has the same meaning as in the Railways Act 2005
rear axis—
(a) in relation to a vehicle with only 1 non-steering axle, means that axle:
(b) in relation to a vehicle with 2 or more non-steering axles, means a horizontal line at right angles to the longitudinal centre-line of the vehicle and midway between the first and last non-steering axles:
(c) in relation to a vehicle with no non-steering axle, means a horizontal line at right angles to the longitudinal centre-line of the vehicle at a point to be determined by the Agency
reflective material means any material or surface that reflects a beam of light generally parallel to the path of the beam and in an opposite direction to that path
registration-plate illumination lamp means a vehicle lamp to illuminate the rear registration plate
reversing lamp means a vehicle lamp to provide a light to the rear to assist a driver when reversing
rider, in relation to any animal, includes a person who, while riding any other animal on a road, leads the first-mentioned animal by a rope, rein, or other similar means of guidance; and ridden animal includes any animal so led
right side, in relation to a vehicle, means its side to the right of the vehicle when the vehicle is facing forward
road includes a street; and also includes any place to which the public have access, whether as of right or not; and also includes all bridges, culverts, ferries, and fords forming part of any road, street, or other place as aforesaid
road margin includes any uncultivated margin of a road adjacent to but not forming part of either the roadway or the footpath (if any)
roadway means that portion of the road used or reasonably usable for the time being for vehicular traffic in general
safety zone means a portion of roadway—
(a) indicated by a structure erected on the roadway; and
(b) that has, near the end first met by approaching vehicles travelling along the side of the roadway on which the safety zone is established, a device displaying to approaching drivers the words “Safety Zone”
sale, in relation to any motor vehicle, includes disposition by way of hire-purchase; and also includes a conditional sale; and sell, seller, and purchaser have corresponding meanings
school bus means a passenger-service vehicle the body of which is designed and used solely or principally for the carriage to and from school of school children; and includes a motor vehicle (not being a motorcar) which is—
(a) a motor vehicle owned by the Crown and operated by the Ministry of Education; or
(b) a motor vehicle operated under contract to the Ministry of Education; or
(c) a passenger service vehicle whose gross laden weight is 3 500 kg or more, and that is for the time being in use for either of the purposes specified in regulation 127(1)
service brake means a brake for intermittent use normally used to slow down and stop the vehicle
shared zone means a length of roadway intended to be used by pedestrians and vehicles that is defined at its beginning by a shared zone sign, and at its end by—
(a) an end shared zone sign; or
(b) a dead end; or
(c) the length of roadway ending at an intersection
side lamp or park lamp means a vehicle lamp of lower power than the head lamps used for the purpose of indicating the presence of the vehicle when seen from a distance and also of indicating the approximate width of the vehicle; and includes—
(a) a forward-facing side lamp, being a lamp indicating primarily the front end of the vehicle:
(b) a rearward-facing side lamp (rear lamp, red tail-lamp), being a lamp emitting a red light indicating primarily the rear end of the vehicle:
(c) a sideways-facing side lamp, being a lamp mounted between the front and rear extremities on the side to indicate primarily the side of the vehicle
signalling device means a vehicle lamp by means of which the driver can indicate his manoeuvring intentions; and includes a stop lamp and a direction-indicator lamp
stop lamp or brake lamp means a lamp operated by the driver when he applies the service brake to give warning of the slowing down or stopping of the vehicle
temporary-use spare tyre has the same meaning as in Part 2 of Land Transport Rule: Tyres and Wheels (2001)
traction engine means a motor vehicle propelled by steam power and designed for use on roads and not for the carriage thereon of goods or of passengers other than the driver
tractor means a motor vehicle (not being a traction engine) designed exclusively for traction at speeds not exceeding 50 km an hour
traffic officer means an enforcement officer under the Land Transport Act 1998 (other than a person who is appointed to that office by the Agency by warrant under section 208 of that Act)
trailer means a vehicle without motive power that is capable of being drawn or propelled by a motor vehicle from which it is readily detachable; but does not include—
(a) a sidecar attached to a motorcycle; or
(b) a vehicle normally propelled by mechanical power while it is being temporarily towed without the use of its own power
trailing unit means any trailer; and includes the rear portion of any vehicle constructed in 2 portions connected by a vertical hinge or pivot, whether or not the 2 portions are readily detachable or the rear portion is powered
turn means to change direction:
provided that if a roadway is marked with a centre line or lane line to show the normal path of vehicles,—
(a) a vehicle shall be deemed to turn if it leaves that path to enter another roadway or vehicle entrance; and
(b) a vehicle following the markings shall be deemed not to turn even though an intersection occurs at a point where the markings are laid out in a curve
uncontrolled intersection means any intersection the traffic at which is not for the time being controlled by a traffic officer, Police officer, or traffic signals
use, in relation to a vehicle, includes driving, drawing, or propelling on any road by means of another vehicle, and permitting to be on any road; and to use and user have corresponding meanings
vehicle means a contrivance equipped with wheels, tracks, or revolving runners upon which it moves or is moved; but does not include—
(a) a perambulator or pushchair:
(b) a shopping or sporting trundler not propelled by mechanical power:
(c) a wheelbarrow or hand-trolley:

vehicle compliance certifier means a person appointed by the Agency under land transport rules to certify motor vehicles in accordance with those rules
warrant of fitness, except in the definition in this regulation of the term evidence of vehicle inspection, means evidence of vehicle inspection
zone parking control, in relation to any road, means a parking restriction imposed by the controlling authority of the road—
(a) that applies to an area comprising a number of roads; and
(b) in respect of which, whether by reason of—
(i) the nature of the area; or
(ii) the nature of the parking restriction; or
(iii) traffic patterns into and within the area; or
(iv) the nature and number of entry points to the area,—
or for any other reason, persons using motor vehicles within the area could reasonably be expected to be aware of the application of the parking restriction to the area without the need for the erection of signs at each intersection within the area; and
(c) which the controlling authority specifically declares to be a zone parking control.

(1) A member of the Police who believes that a motor vehicle involved in an accident has been so damaged that it is unsafe may, by notice under section 115 of the Land Transport Act 1998, direct that the vehicle must not be operated on any road until there has been produced to any member of the Police—
(a) fresh evidence of vehicle inspection; or
(b) a letter from a vehicle compliance certifier advising that fresh evidence of vehicle inspection is not needed.
(1A) The notice may contain a provision to the effect that the vehicle may continue to be operated on the roads for the purpose only of reaching a vehicle compliance certifier and obtaining evidence of vehicle inspection; and the provision may be unconditional, or subject to any limitations (as to speed, route, or any other matter) the member of the Police giving the notice thinks fit.
(2) It shall be an offence for any person to use a vehicle on a road contrary to the terms of any notice issued under subclause (1):
provided that no person shall be deemed to have committed a breach of subclause (1), unless the court is satisfied that the traffic officer or Police officer had reasonable grounds for believing that in all the circumstances of the case the direction was necessary in the interests of the driver or person in charge of the motor vehicle or of any other person or of the public.

(1) In this regulation the term trial means a motor-vehicle reliability trial which exceeds any continuous period of 12 hours, being an organised contest where drivers of motor vehicles compete in driving their vehicles over defined routes and against time schedules for the routes.
(2) Not later than 1 month before the first day fixed for a trial, the organiser of the trial shall supply to the Agency full particulars of the routes and time schedules proposed for the trial, and the organiser shall not proceed with the trial and no person shall drive a motor vehicle in the trial until the Agency has approved, for the purposes of road safety and the protection of the roads over which the trial is to take place, of the routes and time schedules finally issued by the organiser for the information of the drivers.

Every person commits an offence against these regulations who—
(a) knowingly supplies any false or misleading information relating to his obligations under these regulations; or
(b) omits or refuses to supply any information required to be given by him under these regulations; or
(c) with intent to deceive, alters any warrant or certificate of fitness or other document issued under these regulations or any former regulations, or displays on any motor vehicle any altered warrant or certificate of fitness or other document issued under these regulations or any former regulations; or
(ca) with intent to deceive, alters any evidence of vehicle inspection, or displays any altered evidence of vehicle inspection on any motor vehicle; or
(d) fails to comply with a lawful direction, authorised by the Act or these regulations, given by a traffic officer or Police officer; or
(e) fails to comply with any condition, duty, or obligation imposed by these regulations; or
(f) fails to comply with any directions given by any traffic sign or road marking duly erected or made, or does any act prohibited by any such sign or marking; or
(g) offends against or fails to comply with any provision of these regulations:
provided that it is not an offence against these regulations—
(a) for a controlling authority to fail to erect or maintain any traffic sign or marking; or
(b) for a school patrol to fail to comply with regulation 98.

(1) An offence which is detected by approved vehicle surveillance equipment is a moving vehicle offence for the purposes of the definition of that term in section 2 of the Land Transport Act 1998, if it is one of the following:

(b) an offence against any bylaw made under the Transport Act 1962 providing for and regulating the use of priority lanes.
(2) For the purposes of subclause (1), a priority lane is a traffic lane reserved for use under a bylaw made under the Transport Act 1962 by any of the following:
(a) a specified class or classes of vehicle at specified times:
(b) vehicles or a specified class or classes of vehicle occupied by a specified number of persons at specified times.

(b) the revocation of any regulations, warrant, or notice specified in Schedule 5 shall not affect any document made or any thing whatsoever done under the revoked regulations or warrant or notice, and every such document or thing, so far as it is subsisting or in force at the commencement of these regulations and could have been made or done under these regulations shall continue in force and have effect as if it had been made or done under the corresponding provision of these regulations, and as if that provision had been in force when the document was made or the thing was done.

Pursuant to sections 167 and 218 of the Land Transport Act 1998, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
(1) These regulations are the Traffic Amendment Regulations 2006.
(2) In these regulations, the Traffic Regulations 1976 are called “the principal regulations”
.
These regulations come into force on 1 April 2006.
(1) This regulation applies to any person who, before these regulations came into force, committed, or may have committed, an offence against any of regulations 90N to 90Q or regulation 90ZD of the principal regulations (as they were immediately before these regulations came into force).
(2) The principal regulations continue to apply to any person referred to in subclause (1) as if those regulations had not been amended by these regulations.
(3) To avoid doubt, subclauses (1) and (2) apply whether or not, on the date on which these regulations came into force,—
(a) an investigation had been initiated in relation to the alleged offence; or
(b) proceedings had been commenced in relation to the alleged offence.

Under section 16D of the Acts and Regulations Publication Act 1989, reprints are presumed to correctly state, as at the date of the reprint, the law enacted by the principal enactment and by the amendments to that enactment. This presumption applies even though editorial changes authorised by section 17C of the Acts and Regulations Publication Act 1989 have been made in the reprint.
This presumption may be rebutted by producing the official volumes of statutes or statutory regulations in which the principal enactment and its amendments are contained.
